1. Acceptance of Terms

By registering a company account with EVA911 ("the Platform", "we", "us"), you ("the Company", "you") agree to be bound by these Terms & Conditions in full. If you do not agree with any part of these terms, do not proceed with registration. Continued use of the Platform after any update to these terms constitutes acceptance of the revised terms.

2. Eligibility

You must be an authorised representative of the business you are registering, with the legal authority to bind that business to this agreement. You must provide accurate, current and complete information during registration, including but not limited to company identity, contact details, banking details and supporting documents, and you must keep this information updated at all times.

3. Account Review & Approval

Every new registration is reviewed manually by our admin team before the account is activated. Submitting a registration does not guarantee approval. We may request additional documents or clarification, and we may decline an application at our sole discretion, though a short reason will generally be provided.

4. Employee Data Accuracy & Fake Reviews Policy

Fake, fabricated, or knowingly inaccurate reviews, ratings, remarks or reports entered against any employee record are strictly prohibited. This includes, without limitation: inventing disciplinary remarks that did not occur, backdating or fabricating attendance/performance notes to justify wrongful salary deductions or terminations, impersonating an employee to leave a review about themselves, or coordinating with others to post misleading employee feedback. Any Company found engaging in such conduct — whether by direct action of its administrators/users or through an employee acting with the Company's knowledge — may have its account permanently banned without refund of any fees paid, in addition to any other legal remedies available to affected employees or to us. We reserve the right to investigate any report of suspected fake review activity and to require supporting evidence for disputed employee records.

5. Subscription Plans

The Platform is offered under the following plans, each described in full on the Pricing page and reproduced at the point of registration: (a) an 8-month Free Trial plan with limited features; (b) a Standard Plan billed monthly; and (c) an Advance Plan billed monthly with the complete feature set including Global Employee Search. We may introduce, modify, or retire plans from time to time, and will make reasonable efforts to notify active subscribers of material changes affecting them.

6. Setup Fee

A one-time, non-refundable setup fee of ₹300 (Indian Rupees Three Hundred) is payable at the time of registration to cover account provisioning, verification and onboarding costs. Your account will not be activated until (i) this fee is received and (ii) your registration has been separately approved by our admin team. Both conditions must be satisfied independently.

7. Free Trial & Automatic Continuation Billing

The Free Trial plan runs for 8 (eight) months from the date your account is approved and activated, at no charge, subject to the feature limitations described on the Pricing page. Global Employee Search is not available on the Free Trial plan and can only be unlocked by upgrading to the Advance Plan, or, at our discretion, by an administrator manually granting access to your account.

Unless you cancel or upgrade before the trial period ends, your account will automatically convert to a paid Continuation Plan billed at $50 (USD) per month, charged to the payment method associated with your account, starting immediately after the trial expires. You may upgrade at any time during or after the trial to the Standard Plan ($49/month) or the Advance Plan ($99/month) instead of remaining on the Continuation Plan, by requesting an upgrade from within your dashboard.

8. Minimum Commitment Period — No Cancellation Before 2 Years

By registering, you agree that your account and subscription commitment may not be cancelled, and no refund will be issued, before the completion of 2 (two) full years from your original registration date, regardless of which plan (Free Trial, Continuation, Standard, or Advance) you are on at any given time during that period, and regardless of upgrades or downgrades between plans during that period. This minimum commitment exists because significant onboarding, data-migration, support and verification work is performed on your account from day one. If you believe exceptional circumstances apply to your situation, you may write to us and we will review requests on a case-by-case, discretionary basis; approval of any such request is not guaranteed.

9. Payments & Discounts

All payments are processed through our designated payment partner. Payment references you submit are manually verified by our team before your account or upgrade is fully activated; this may take up to 24–48 hours. From time to time, and at our sole discretion, we may apply a promotional discount to your subscription; any discount shown in your dashboard is valid only for the period stated and may be withdrawn on renewal unless explicitly extended.

10. Account Suspension & Blocking

We may suspend, block, or restrict access to your account, with or without prior notice, if: (a) payment is overdue; (b) you breach these Terms, including the Fake Reviews Policy in Section 4; (c) we reasonably suspect fraudulent, abusive, or illegal use of the Platform; or (d) required to do so by law or by a competent authority. Where an account is blocked, a reason will typically be recorded and made available to you on request.

11. Data You Enter

You are solely responsible for the accuracy and legality of employee, payroll, financial and other data you enter into the Platform. We act as a data processor for the records you create and do not independently verify the truthfulness of the information you submit, except where specific verification workflows (such as document review during registration) are described in these Terms.

12. Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages arising from use of the Platform, including but not limited to payroll calculation errors resulting from data you entered, third-party payment gateway downtime, or loss of data due to circumstances outside our reasonable control.

13. Changes to These Terms

We may update these Terms from time to time. Where changes are material, we will make reasonable efforts to notify active account holders. Continued use of the Platform after a change takes effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, and any disputes shall be subject to the exclusive jurisdiction of the competent courts having jurisdiction over our registered place of business.
